This agreement is made between the owners and the guests of the St. Joe River Retreat.  PARTIES AGREE AS FOLLOWS:

1. OWNER shall grant full use of rental home and property (EXCLUDING BASEMENT and GARAGE ACCESS) at 345 Milwaukee Road in Avery, Idaho for the prospective dates, upon acceptance of terms and the receipt of all applicable charges.  

2. REFUNDS will be made only when a cancellation is requested 30 days before scheduled arrival. All funds received will be returned less a $50 cancellation fee.

Should a cancellation be made within 30 days of scheduled arrival only the damage deposit (if withheld) will be refunded to guest. All rental costs and associated taxes will be forfeited to the owner. No refund will be granted due to cancellations made due to weather conditions, air quality or temperature.

3. BEDDING, towels, home, and kitchen supplies are provided for the guests.

4. PHONE SERVICE: Phone service is cellar accessed from the private server. There is no land line phone service to the home.

5. SMOKING is not permitted inside the home.

6. BASEMENT ACCESS IS PROHIBITED. The basement is locked to guests and used for storage of utility, maintenance, and stocking items. Attempted entry will result in damage to the property and forfeiture of full security deposit.

7. GUEST agrees to maintain the home in the condition it was in at the time he took possession and to assume responsibility for any loss or damage beyond normal wear and tear. GUEST shall leave the cabin and property in a clean condition.

8. PETS are welcome although you MUST clean up after your pet and maintain control of your pet at all times. NEVER leave your dog unattended. If you are leaving for the day you must take your dog with you. Any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the lease and forfeiture of the tenant's entire security deposit.

9. SLEEPING CAPACITY/DISTURBANCES: Tenants and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: A.) Occupancy exceeding the sleeping capacity stated on the reservation confirmation. B.) Using the premises for any illegal activity including, but not limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age. C.) Causing damage to the premises rented or to any of the neighboring properties. D.) Any other acts which interferes with neighbors' right to quiet enjoyment of their property.

10. HOLD HARMLESS: The owners do not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. Nor will the owners accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control.

11. IN THE EVENT that guest breaches any of the terms/conditions of this agreement, the owner shall be entitled to attorney's fees and or damage deposits in any action brought to enforce these terms.

12. GUEST is responsible for this agreement and shall not re-assign this agreement or sublet the home.

13. CHECK IN TIME IS 3:00 PM, CHECK OUT TIME IS 10:00 AM unless prior arrangements have been made.
